  1. No export or import shall be made by any person without an Importer-Exporter Code (IEC) Number unless specifically exempted. An Importer/Exporter Code (IEC) number shall be granted on application to the competent authority.
  2. The following categories of importers or exporters are exempted from obtaining Importer-Exporter Code Number (IEC) number:
    • Importers covered by clause 3(1) {except sub-clause (e) and (l)} and exporters covered by clause 3(2) {except sub-clauses (i ) and (k) } of the Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993.
    • Ministries/Department of the Central or a State Government.
    • Persons importing or exporting goods for their personal use not connected with trade or manufacture or agriculture.
    • Persons importing/exporting goods from/to Myanmar through Indo-Myanmar border areas provided the CIF value of a single consignment does not exceed Indian Rs.25,000/-.


  1. An IEC Number allotted to an applicant shall be valid for all its branches/divisions/units/factories as indicated on the IEC number.
  1. Where an IEC Number is lost or misplaced, the issuing authority may consider requests for grant of a duplicate copy of IEC number, if accompanies by an affidavit.

A Partnership is the relation between persons who have agreed to share profits of the business carried on by all or any of them acting for all. This definition gives three minimum requirements to constitute a partnership, viz.

  • There must be an agreement entered into orally or in writing by the persons who desire to form a partnership,
  • The object of the agreement must be to share the profits of business intended to be carried on by the partnership, and
  • The business must be carried on by all the partners or by any of them acting for all of them.


Not only that but it has been held that the Karta of a H.U.F can enter into partnership with an individual member of that very family provided the member has contributed his own self acquired capital by way of money or other property to the capital of the firm.

The partnership business may consist of doing anything which is not illegal or against public policy. Business may consist of carrying a continuous trade. Or profession or any manufacture and any other activity of which the object is to earn profits. Or it may be limited to a single adventure.

It is also described as a commercial or maritime enterprise undertaken by several persons jointly, a limited partnership, not limited in the statutory sense as to the liabilities of the partners, but as to its scope or duration.

It is recognized on authority that each of the partners must have equal voice in the matter of performance and control over the activities used therein though one authority may entrust the performance to another.
